DETAILED REGULATIONS 1 - SPECIAL PROVISIONS OF VARIOUS DOMAINS
EArticle 1. Special Provisions regarding gJapanese JP Domain Name.comh
- 1.1 As part of the Service provided by GMO, the Japanese IDN registration service for .com Domains, .net Domains, and .org Domains (hereinafter referred to as the gJapanese IDN.comh) registers Domain Names in Japanese characters within the internationalized domain names (hereinafter referred to as gIDNh) registered/managed by the Registry. The Registrant, in applying for registration, shall recognize and bear the following risks:
- (a) Disappearance or usage failure of the Domain Name due to failures of the IDN registration system;
- (b) Complete failure of use of the Domain Name registered during the period stipulated by the Registry;
- (c) Occasional failure of use of the registered Domain Name due to failures of the IDN registration system;
- (d) Possibility of a Domain Name dispute due to an infringement of trademark rights;
- (e) Service discontinuance of IDN or Japanese IDN.com due to failures of the IDN registration system;
- (f) Fees associated with the registration procedure and the renewal procedure of a Domain Name are non-refundable after the respective procedures are deemed to be completed; and
- (g) Any other potential risks arising from other IDN domain registration systems.
- 1.2 Items not described in this Article shall be governed by the provisions of the Regulations.
EArticle 2. Special Provisions regarding the g.jp Domainh Registration Service
- 2.1 In this Article, the following terms shall have the meanings attributed to them:
- (a) gApplicanth shall mean the individual or entity applying for the registration of the .jp Domain;
- (b) gJPRSh shall mean Japan Registry Services Co., Ltd.;
- (c) gJPRS Agreementh shall mean the agreement entered into between GMO and Japan Registry Services Co., Ltd.; and
- (d) g.jp Domainh shall mean -
- (i) General-use JP Domain Name, as defined in the gRules to register General-use JP Domain Nameh as stipulated in the JPRS Agreement; and
- (ii) Organizational Type JP Domain Name, which includes the .co.jp, .ed.jp, .go.jp, .ac.jp and .or.jp Domains as set forth in Article 3 of the gRules to register Organizational (by organization type)/ geographic Type JP Domain Nameh as stipulated in the JPRS Agreement.
- 2.2 The .jp Domain registration service is part of the Service offered by GMO. GMO is the official designated business partner by agreement with Japan Registry Services Co., Ltd. (hereinafter referred to as gJPRS Agreementh) to engage in the business of the intermediation of .jp Domain Name registration applications. The .jp Domain registration service shall be governed by the JPRS Agreement.
- 2.3 Domain Names registered under the .jp Domain shall be subject to the following provisions (including, amongst other things, provisions which restrict the number of Domains an applicant may apply for):
- (a) For General-use JP Domain Names, the gRules to register General-use JP Domain Nameh as stipulated in the JPRS Agreement; and
- (b) For Organizational Type JP Domain Names, the gRules to register Organizational (by organization type)/ geographic Type JP Domain Nameh as stipulated in the JPRS Agreement.
- 2.4 GMO may provide an gLocal Presence Serviceh via a separately stipulated procedure to an Applicant who wishes to register a General-use JP Domain Name but who does not have a Japanese address.
- 2.5 The Applicant shall agree to abide by the following terms in applying for the gLocal Presence Serviceh:
- (a) The rights and obligations of a Domain Name disclosed by alternative information shall belong to the Registrant;
- (b) There is a possibility that mails, telephone calls, faxes, and e-mails regarding the registration status of the Domain Name may not be forwarded, and the Registrant may be disadvantaged as a result;
- (c) Service setting costs are non-refundable;
- (d) The cancellation procedure for the gLocal Presence Serviceh of the Domain shall be followed prior to a Transfer Out.
- 2.6 Where the Registration Period, as stipulated in Article 15 of the Regulations, is two (2) years or more for each registration procedure or each renewal procedure, the Registrant shall agree to the following terms:
- (a) During the registration procedure or the renewal procedure, GMO shall act as an agent of JPRS for the initial year during the Registration Period. For the remaining number of years within the Registration Period, GMO may renew its agreement to act as an agent for JPRS for a year thereafter, and shall review this on a year-to-year basis.
- (b) The Registrant may not change the designated business operator of the registered Domain Name until one year from the date the Registration period expires.
- (c) In the event that the Registrant violates Article 2.6(b), the provisions under Article 17 of the Regulations shall apply. In addition, the Registrant shall pay to GMO all fees payable for the entire Registration Period.
- (d) When the Registrant reports the deletion of the Domain Name stipulated in Article 17 of the Regulations, the provisions of Article 17 of the Regulations shall apply for the fees payable for the remaining period. For the avoidance of doubt, the fees payable for the remaining period shall be non-refundable.
- 2.7 Any .jp Domain Name disputes shall be resolved pursuant to the gJP Domain Name Dispute Resolution Policyh as stipulated by JPRS, with no further response by GMO.
- 2.8 Items not described in this Article shall be governed by the provisions of the Regulations. For items not governed by the provisions of the Regulations, the provisions in the "Rules for General-Use JP Domain Name Registration, etc." and "Rules for Organizational/Geographic Type (By Organization Type) JP Domain Name Registration, etc." stipulated by JPRS shall apply.
EArticle 3. Special Regulations regarding the g.biz Domainh Registration Service
- 3.1 This Article applies to Registrants of .biz Domains.
- 3.2 The .biz Domain shall be used by businesses or for commercial purposes.
- 3.3 The Registrants of a .biz Domain shall agree to the following:
- (a) The .biz Domain shall not be registered or used for non-commercial individual use;
- (b) The .biz Domain shall not be sold, traded or rented for the purpose of financial gain; and
- (c) The .biz Domain shall not be offered for disposal, exchange or lease.
- 3.4 The registered .biz Domain shall be reasonably relevant to the Registrantfs business at the time of registration.
- 3.5 The Registrant, in applying for the Japanese IDN registration service for .biz Domains (hereinafter referred to as the gJapanese IDN.bizh), shall recognize and bear the following risks:
- (a) There are IDN-specific restrictions in the use of the Domain;
- (b) It is unknown when such IDN-specific restrictions will be removed; and
- (c) There are potential risks related to IDN registration.
- 3.6 The gUniform Domain Name Dispute Resolution Policy 2:1-2h and gRestrictions Dispute Resolution Policy 2:3-1h shall apply to the dispute resolution policy of the .biz Domain. The Registrant warrants and represents that he/she has thoroughly read, comprehended, and agreed to be bound by the provisions and policies contained therein. In addition, the Registrant acknowledges that such provisions and policies may be amended from time to time.
- 3.7 Items not described in this Article shall be governed by the provisions of the Regulations.
EArticle 4. Special Regulations regarding the g.info Domainh Registration Service
- 4.1 With regards to the .info Domain registration service, GMO is an official Registrar, accredited by ICANN, entrusted to act as an agent of .info Domain registration applicants. GMO offers such a registration service pursuant to an agreement with Afilias Limited, which is the Registry of the .info Domains.
- 4.2 Registrants of the .info Domains shall comply with the provisions of the agreement between GMO and Afilias Limited.
- 4.3 Items not described in this Article shall be governed by the provisions of the Regulations.
EArticle 5. Special Regulations regarding the g.cn Domainh Registration Service
- 5.1 With regards to the .cn Domain registration service, GMO is an official Registrar entrusted to act as an agent of .cn Domain registration applicants. GMO offers such a registration service pursuant to an agreement with China Internet Network Information Center (hereinafter referred to as gCNNICh), which is the Registry of .cn Domains, and an agreement with NeuLevel, which has Registry authority over the .cn Domains.
- 5.2 Registrants of the .cn Domains shall comply with the provisions of the agreement between GMO and CNNIC and the provisions of the agreement between GMO and NeuLevel.
- 5.3 Registrants of the .cn Domains may use and register the Domain Name only for companies and organizations and such Registrants may not purchase, exchange or lease Domain Names for individual use, non-commercial use or financial gain. Additionally, the Registrants of the .cn Domains shall not offer the Domain Names for disposal, exchange or lease.
- 5.4 Registrants of the .cn Domains shall comply with the laws and regulations of the Peoplefs Republic of China and the regulations of the CNNIC including but not limited to the following:
- (a) CNNIC Implementing Rules of Domain Name Registration 2:4-1;
- (b) China Internet Domain Name Regulations 2:4-2;
- (c) CNNIC Domain Name Transfer Registrars Rule 2:4-3;
- (d) CNNIC Domain Name Dispute Resolution Policy 2:4-4; and
- (e) Rules for CNNIC Domain Name Dispute Resolution Policy 2:4-5.
- 5.5 Registrants of the .cn Domains who violate the provisions in Articles 5.3 and 5.4, shall have their corresponding Domain Names deleted.
- 5.6 Domain Name disputes shall be resolved pursuant to the dispute resolution policy contained in the agreements specified in Article 5.4(d) and Article 5.4(e), with no further response from GMO.
- 5.7 Registrants of the .cn Domains agree that CNNIC, NeuLevel and GMO shall not be liable for any damage or loss arising from any order pursuant to any Domain Name disputes.
- 5.8 Items not described in this Article shall be governed by the provisions of the Regulations.
EArticle 6. Special Regulations regarding the g.mobi Domainh Registration Service
- 6.1 This Article applies to Registrants of .mobi Domains.
- 6.2 Registrants of .mobi Domains shall thoroughly read, understand and comply with the regulations, rules and policies listed in the following items:
- (a) .mobi Registrant Agreement 2:4-1; and
- (b) DotMobi Switch On! Web Developer Guide 2:4-2.
- 6.3 Registrants of .mobi Domains agree that mTLD monitors the website managed by the registered .mobi Domain according to the regulations and rules stipulated by mTLD. In addition, the Registrants acknowledge that such regulations and rules may be amended based on the sole discretion of mTLD, and agree to comply with any such amendments.
- 6.4 In the event a Registrant of a .mobi Domain violates a regulation or rule stipulated by mTLD, the Registrant shall correct any such violations in accordance with the policy within the stipulated period. If the Registrant does not make the correction within the stipulated period, the mTLD or GMO reserves the right to delete the Domain Name from the Internet name resolution zone files and the website shall be unusuable until such time as the correction is completed.
- 6.5 Registrants of .mobi Domains agree that mTLD possesses the right to reserve Domains subject to Domain Name disputes in a usuable state during a dispute.
- 6.6 Items not described in this Article shall be governed by the provisions of the Regulations.
EArticle 7. Special Regulations regarding the gJapanese IDN.tv Domainh Registration Service
- 7.1 The Registrant, in applying for the Japanese IDN registration service for .tv Domains (hereinafter referred to as the gJapanese IDN.tvh), shall recognize and bear the following risks:
- (a) There are IDN-specific restrictions in the use of the Domain;
- (b) It is unknown when such IDN-specific restrictions will be removed; and
- (c) There are potential risks related to IDN registration.
- 7.2 Items not described in this Article shall be governed by the provisions of the Regulations.
